Public Contract Offer and Private Policy


1. General Provisions 

1.1. “Russian caviar house” Limited liability company, hereinafter referred to as “Seller”, publishes this Public Contract Offer for distant selling (via the Internet) of its goods represented at the official website
1.2. In accordance with par. 437 and par. 438 of the Russian Federation Civil Code (RFCC) this document is a Public Contract Offer, which means that an individual accepting this Offer (hereinafter referred to as “Buyer”) is to make payment for the goods supplied by Seller in compliance with the terms of the Offer. 
1.3. Before accepting the Offer please read its provisions carefully. In case of any disagreement you can refuse from buying the goods from the Seller. 
1.4. Terms used in this Offer have the following meaning: 
• "Offer" – a public offer of Seller addressed to any individual to enter a purchase contract (hereinafter “Contract”) on conditions stipulated herein. 
• "Seller” – company selling the goods represented at website
• "Buyer" – an individual entering the Contract on conditions stipulated herein. 
• "Acceptance" – full and absolute acceptance of the Contract conditions. 
• "Goods" – the assortment list represented at Seller’s website
• "Order" – items from the assortment list of Goods indicated by Buyer when placing an order via the website or telephone operator. 
• "Operator" – a representative of Seller consulting Buyer before placing an order by phone or interactive messenger. 
• "Courier" – a representative of Seller making delivery of Order to Buyer. 
1.5. This Contract Offer is composed in compliance with the ‘Rules for distant commerce’ approved by the government of the Russian Federation as of 27 September 2007. 

2. Subject of Contract 
2.1. Seller sells its Goods in accordance with the actual pricelist published at Seller’ website, and Buyer accepts and pays for the Goods according to the terms of this Contract. 
2.2. This Contract is an official document being an integral part of the Seller’s Offer and is published at Seller’s website

3. Order Placement 
3.1. Buyer can place an order via the Seller’s website or Operator. 
3.2. When placing an order via the website or through Operator, Buyer shall submit the following personal information (in English): 
• Name and surname; 
• Address for delivery; 
• e-mail address; 
• valid telephone number for contact. 
3.3. The terms of this Contract are recognized as accepted if Buyer conveys his/her personal information indicated in clause 3.2 to Seller. By transmitting his/her personal information through the registration form at the website, Buyer creates a personal account at Sellers website database, gets assigned with a personal ID number, login and password, which are sent to his/her e-mail. Buyer has right to edit his/her personal information (account details) indicated at registration. Seller is obliged not to change/edit Buyer’s account without Buyer’s consent, not to convey his/her personal information to third parties (unless it is required by the law) and undertakes to delete his/her account if Buyer applies to seller with such a request. If Order is placed via Operator, Buyer is also registered at Seller’s database, and a personal account is created for him/her at the website for keeping history of orders. If Order is placed at the website, Buyer will receive a confirming letter by e-mail. 
3.4. Buyer is responsible for the content and accuracy of the provided contact information. 
3.5. All the informative materials represented at the Seller’s website are referential and cannot to the full extent impart information on such characteristics of the Goods as taste, color, size, packaging. In case Buyer has any questions concerning the Goods he/she is interested in, he/she should consult Operator or send a request (by e-mail to or via the web form) before placing an order. 

4. Order Execution Period 
4.1. Seller undertakes to execute the Order within the period lasting from 1 working day till two weeks. This period depends on availability of the Goods at stock or on time required for delivery to the indicated address. Date and time of delivery should be agreed between Operator and Buyer for each Order. If for any reason some part of the Order is out of stock Seller has right to exclude the missing item from the Order upon consent of the Buyer. Buyer has right to cancel the whole Order if any part of it is out of stock and cannot be delivered within the acceptable period. 
4.2. Order is considered fulfilled at the moment of handing over the ordered Goods to Buyer. 
4.3. Cost of Order delivery is defined by the tariffs published at the Seller’s website. The tariffs and terms of delivery may always be clarified by Operator. 
4.4. Seller is not responsible for failure to comply with the agreed date and time of delivery in case Buyer provided incorrect contact information (wrong address or telephone number). If the Order is not delivered due to Buyer’s fault, the repeated delivery should be made at Buyer’s expense. 
4.5. In case of improper fulfillment of the Order due to Seller’s fault, the repeated delivery shall be made as soon as possible at Seller’s expense. 
4.6. In case Operator cannot get into contact with Buyer within 7 days after the Order has been placed, Seller has right to cancel the Order. 

5. Terms of Payment 
5.1. Payment for the Order may be executed by the following methods: 
a) by cash (in Russian rubles only) on delivery to Courier; 
b) by bank card (Visa or MasterCard) in case of Customer pickup at Seller’s wharehouse; 
c) by advance e-payment via the PayMaster system. 
5.2. The price for each item of the Goods is indicated at the website 
and can be changed by Seller at any time on a unilateral basis. In case the price changes after the Order is placed, Operator should inform Buyer about such change as soon as possible. Buyer has right to confirm or cancel the Order. 
5.3. The Buyer’s account is accumulative which means that he/she is to receive an accumulative discount on Orders. The amount of this discount depends on the sum of all of black caviar (only) made and paid in the Seller’s Internet shop, according to the Seller’s effective discount system. One-time promo discounts and accumulative discounts are not to be summed up. 
5.4. Payment of the Order placed by Buyer via the Seller’s website or Operator is considered as acceptance of the Contract conditions. The date of payment is the date of conclusion of this Contract Offer between Buyer and Seller. 

6. Return of Ordered Goods 
6.1. In accordance with par. 26.1. clause 4 of the Russian Federation law N 2300-I on "Protection of consumers’ rights”, Buyer has right to refuse from the ordered Goods at any time before the Order is fulfilled, as well as at the moment of receipt and inspection of the delivered Goods. 
6.2. In accordance with par. 25 of the Russian Federation law N 2300-I on "Protection of consumers’ rights”, the perishable goods cannot be returned to Seller after acceptance. 
6.3. In case of delivery of the Goods of improper quality Buyer is obliged to convey the Goods to Seller’s office as soon as possible in order to enable Seller to inspect the goods and define the quality defects. 
6.4. In case the ordered Goods are handed over to Buyer with any infringement of this Contract in terms of quantity, assortment, quality, packaging, Buyer has right to claim that to Seller within 1 day after receipt of the Order. 
6.5. The Goods of improper quality can be returned or exchanged under the following conditions: 
- their vendibility has been preserved; 
- their consumer properties have been preserved; 
- availability of the document confirming the fact of purchasing at Seller’s on-line store. 
Return or exchange of the Goods can be made only at Seller’s office upon preliminary agreement. 

7. Copyright 
7.1. All the text information and graphic elements posted on the Seller’s website 
are the property of Seller and/or Seller’s suppliers of Goods. 

8. Rights, Obligations and Responsibility 
8.1. Seller is obliged to convey the Goods to Buyer in accordance with his/her Order under the terms and conditions of this Contract. 
8.2. Seller is not responsible for improper use of the Goods ordered by Buyer through the Seller’s website or Operators. 
8.3. Seller has right to transfer his rights and obligations in respect of Order fulfillment to third parties. 8.4. Seller has right to record telephone conversations with Buyers for the purpose of control over Operators and service quality checks. According to par. 16 of the Russian Federation law on “Information, IT and protection of information”, Seller is obliged to prevent any unauthorized access to Buyer’s information by parties irrelevant to Orders execution. 
8.5. In accordance with par.436 of the Civil Code of the Russian Federation, this Contract Offer is not irrevocable, Seller or Operator has right to refuse to accept Orders from individuals who do not accept the terms and conditions of this Contract. 
8.6. Buyer undertakes not to use the Goods ordered at Seller’s website or via Operator for commercial purposes. 
8.7. The rights for the ordered Goods, as well as the risks of loss, are transferred to Buyer at the moment of handing over the paid Order to Buyer. 
8.8. Any claims concerning the quality of Goods or services rendered with respect to Order fulfillment can be sent to or communicated to Operator.
